SERVICE AGREEMENTS

It all begins with an idea.

What is a Service Agreement?
A service agreement is an agreement between you and your provider that makes it clear what you have both agreed to and what the expectations are during the service agreement.

Providers should support you to understand your service agreement using the language and a way of communicating you understand and are comfortable with.

Who Needs a Service Agreement?

A written service agreement must be in place for Specialist Disability Accommodation (SDA) supports under the NDIS.

For other supports, the NDIA does not require a written service agreement, however, it is good practice to mitigate any potential disputes.

Why Do We Need a Service Agreement?

Service agreements set out key information when a participant engages with a provider.  It is there to protect both parties, clearly identify key information with the services/supports being delivered and mitigates potential problems by providing clarity on pricing, services and responsibilities of all involved - preventing disputes in the future.

Service agreements also assist Plan Managers to allocate funding accordingly to the provider based on what has been set out and signed in the service agreement.

What Does a Good Service Agreement include?

  • Participant details including preferred contact method

  • Details of the plan nominee/guardian (if applicable)

  • The Provider’s information

  • What Services/supports are being provided

  • The cost of the supports (including travel costs)

  • The responsibilities of your provider

  • Your responsibilities as a participant

  • How long the agreement goes for and how it can be changed

  • The dispute resolution process.

  • How to end a service agreement

  • Set out in a format and uses language that is understandable

Further information:

It is very important that you read and understand everything included in the Service Agreement. There is often a lot of information and if it is unclear, providers should  present the information in a different way (simpler, different language, pictures/video). Only when you are satisfied that you understand and agree with what is detailed, should you sign your service agreement.
